These Terms of Service ("Terms") govern your access to and use of the AlphaIQ platform ("the Platform"), operated by J&A Marsh Investments Pty Ltd (ABN pending) ("we", "us", "our"), based in Perth, Western Australia.
By creating an account or using the Platform, you agree to be bound by these Terms. If you do not agree, do not use the Platform.
You must be at least 18 years of age and a resident of Australia to use AlphaIQ. By using the Platform, you represent and warrant that you meet these requirements. We reserve the right to verify eligibility and to suspend accounts that do not meet these criteria.
You are responsible for maintaining the security of your account and for all activity that occurs under it. You agree to:

AlphaIQ is a self-service informational tool designed to help you organise, analyse, and understand your own financial data. Specifically:

We reserve the right to suspend or terminate your account for violation of these Terms without notice.
Plans: AlphaIQ offers Free, Starter ($29/month or $290/year), and Pro ($59/month or $590/year) plans. Plan features and pricing may change with reasonable notice.
Billing: Paid subscriptions are billed in advance on a recurring monthly or annual basis via Stripe. By subscribing, you authorise us to charge your payment method at the applicable rate.
Credit top-ups: Pay-as-you-go credit packs are one-time purchases. Credits are valid within the billing period and do not carry over unless otherwise stated.
Tax deductibility: We may indicate that subscriptions may be tax deductible as an investment management expense. This is general information only and depends on your individual tax circumstances. Consult your tax professional for advice specific to your situation.
Cancellation: You may cancel your subscription at any time. Cancellation takes effect at the end of your current billing period. We do not provide pro-rata refunds for unused portions of a billing period.
Refunds: Refund requests will be assessed on a case-by-case basis. We are not obligated to provide refunds except as required by Australian Consumer Law.
Australian Consumer Law: Nothing in these Terms excludes, restricts, or modifies any rights you have under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) that cannot be excluded, restricted, or modified by agreement.
All content, features, functionality, design, code, and branding of the Platform are owned by J&A Marsh Investments Pty Ltd and are protected by Australian and international intellectual property laws.
You retain ownership of the financial data you input into the Platform. By using the Platform, you grant us a limited licence to process your data solely for the purpose of providing the service to you.
AI-generated outputs (such as Growth Scanner reports, thesis analyses, and intelligence feed items) are provided for your personal use. You may use these outputs for your own investment decision-making. You may not resell or commercially redistribute AI-generated outputs.
Your privacy is important to us. Our collection, use, and handling of your personal information is governed by our Privacy Policy, which forms part of these Terms.
Document sharing: When you generate shareable document links, you are responsible for who you share those links with. We provide access tracking and expiry controls, but you are responsible for managing access to your shared documents.
To the maximum extent permitted by Australian law:
Some jurisdictions do not allow the exclusion of certain warranties or the limitation of liability for certain types of damages. In such cases, our liability will be limited to the maximum extent permitted by law.

The Platform integrates with third-party services including Google (authentication), Stripe (payments), Supabase (database), and AI API providers. Your use of these services is subject to their respective terms and privacy policies. We are not responsible for the practices or policies of third-party service providers.
We reserve the right to modify, suspend, or discontinue any part of the Platform at any time, with or without notice. We will make reasonable efforts to notify you of material changes. We are not liable for any modification, suspension, or discontinuation of the Platform.
We may update these Terms from time to time. We will notify you of material changes via email or a prominent notice on the Platform. Your continued use of AlphaIQ after changes are posted constitutes acceptance of the updated Terms. If you do not agree, you should stop using the Platform.
We may terminate or suspend your account and access to the Platform at our sole discretion, without prior notice, for conduct that we determine violates these Terms or is harmful to other users, us, or third parties, or for any other reason.
Upon termination, your right to use the Platform ceases immediately. Provisions of these Terms that by their nature should survive termination shall survive, including intellectual property, limitation of liability, indemnification, and governing law.
These Terms are governed by and construed in accordance with the laws of Western Australia, Australia. Any disputes arising from these Terms or your use of the Platform shall be subject to the exclusive jurisdiction of the courts of Western Australia.
Before initiating formal legal proceedings, you agree to attempt to resolve any dispute by contacting us directly. We will endeavour to resolve disputes in good faith within 30 days.
If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.
These Terms, together with our Privacy Policy and Disclaimer, constitute the entire agreement between you and J&A Marsh Investments Pty Ltd regarding your use of the Platform.
